General Rules and Principles

International Academic Staff:

Article 34 - International academic staff appointed by contract at higher education institutions are appointed by the rector upon the recommendation of the relevant faculty, graduate school, or school administrative board and the approval of the university?s administrative board. They are subject to the provisions set forth in this law for salaried academic staff regarding their teaching duties.

(Amended: 17/8/1983 - Article 17) The appointment or assignment of international academic staff in this manner does not require the Presidential approval provisions of Law No. 657 on Civil Servants. Instead, it is done following preliminary approval by the Council of Higher Education and obtaining a work permit from the Ministry of Labor and Social Security, after which a contract is made with the relevant university.

(Additional paragraph: 2/7/2018 - Decree Law No. 703/43) The number of international academic staff appointed by contract in higher education institutions according to this article and Article 16 of Law No. 2914 on Higher Education Personnel cannot exceed 2% of the academic staff positions. The distribution of international academic staff across higher education institutions, including their names, salaries, contract examples, contract renewals, and terminations, is managed by the Council of Higher Education.

Salary

At the Higher Education Executive Board meeting on September 21, 2022, regarding the international academic staff employed on a contractual basis at state higher education institutions:

  1. It was decided to delegate the authority to increase the gross contract salaries up to the rate of increase in the officer salary coefficient for January and July to the university administrative boards. Additionally, the new gross contract salary information, resulting from the increase made by the university administrative boards, should be entered into the Higher Education Information System (YÖKSİS).
  2. It was decided that requests for increases in gross contract salaries exceeding the rate of increase in the officer salary coefficient should be sent to the Council of Higher Education with detailed justifications for a decision.

However, in July 2023, there was an increase of 17.55% in the officer salary coefficient. Additionally, Law No. 7446 added Article 40 to the Decree Law No. 375, stipulating that academic staff receive additional payments equivalent to the indicator figure (15,965) and the officer salary coefficient. This payment is exempt from any tax and social security premium deductions, except for stamp duty.

In this context, the Higher Education Executive Board decided in its meeting on July 21, 2023, to delegate the authority to the university management boards to increase the contract salaries of international academic staff in July 2023, limited to the extent of the salary increase percentage applied to their equivalent academic staff.

Assignment

The decision by the Council of Higher Education regarding the assignment of international academic staff abroad is as follows:

 

The Executive Board of the Council of Higher Education has determined the rules regarding the assignment of international academic staff abroad at the meeting on September 24, 2014. According to Article 34 of Law No. 2547, international academic staff employed under this law cannot be assigned abroad for periods of 3 months or longer. However, these international academic staff may be assigned to very short-term activities abroad, such as conferences, panels, or seminars, provided that they do not neglect their legal obligations (such as mandatory teaching duties).
